Private Chef & Private Cook Addendum

1. Independent sellers and lawful service methods

Your food or culinary service is provided by the identified independent seller. Sellers may offer cooking at a customer’s location, delivery, or pickup only where that food, preparation location, and service method are lawful. Calling an offering a personal service does not change its legal classification or permit otherwise prohibited food sales.

2. Kitchen and seller disclosures

Some offerings may be prepared in a private home kitchen. Licensing and inspection requirements vary by location and activity; do not assume every home kitchen is exempt or uninspected. Sellers must accurately disclose their preparation setting, required registrations or permits, applicable inspection status, ingredients, allergens, and legally required home-kitchen notices before a customer orders. Customers should review those disclosures and ask the seller about any uncertainty.

3. Seller standards and compliance affirmation

Sellers must meet the Seller Compliance Affirmation, maintain applicable permits and food-safety credentials, carry liability insurance covering their services, and supply accurate documents when requested. Private chefs and cooks must provide a valid ServSafe or accepted equivalent food-safety certificate through the platform’s verification process. Certification and document review do not substitute for required permits or guarantee legal compliance or insurance coverage.

Sellers are responsible for confirming local restrictions on food types, revenue limits, labeling, delivery, pickup, and preparation premises. They must not offer an item or method their jurisdiction prohibits. They must promptly report safety incidents, recalls, and loss of required credentials or coverage and stop affected sales.

4. Food safety and customer responsibilities

Sellers remain responsible for safe preparation, storage, transport, accurate ingredient and allergen information, and fulfillment. Customers should communicate allergies and dietary needs before ordering, confirm whether the seller can accommodate them, inspect the order at handover, and follow safe storage and reheating instructions. No listing can guarantee absence of cross-contact unless the seller can substantiate that claim.

Purchases are for personal consumption. The restriction on physically reselling a purchased meal does not prevent an eligible customer from promoting the seller’s listing under the repost and menu collection provisions; those new orders are fulfilled by the original seller.

5. Platform role and allocation of responsibility

FlexiEats provides marketplace technology; it does not prepare, inspect, store, or transport food for these orders, inspect kitchens, or employ private chefs and cooks. Document checks are not a food-safety inspection or a guarantee that a seller meets every local requirement. The indemnification and liability provisions in section 7 of the Terms apply, including their legal limits. Customers do not waive nonwaivable rights or agree to indemnify a seller merely by purchasing a meal.

6. Order concerns, refunds, and acceptance

Contact the seller promptly about an order issue. Safety concerns, unresolved complaints, or policy violations may also be reported to support@flexieats.com. Under the Refund & Cancellation Policy, ordinary refunds after PIN-confirmed receipt require the original seller’s approval; FlexiEats may facilitate and process an approved refund. Refunds or reversals required by law or payment-provider rules remain available. A receipt PIN does not waive nonwaivable rights.

By accepting the applicable checkout acknowledgment, you confirm that you have read this Addendum and the seller’s disclosures and agree to the responsibilities described here. If you do not agree, do not place the order. The governing-law and mandatory-rights protections in the Terms apply.
